the tunes need to have some recognisable x-mas track part in it - doesnt matter if its a sample or if you model you bassline to a x-mas tune, as long as it has a recognisable x-mas vibe to its its ok ;)

mhhh. good question....i think jingle bells is public domain, as long as you dont use a recorded version (read - use midi & generate it yourself with vst's or something)
