This is the second time that people from LABOMIX ( http://www.labomixfrequencies.com/page11a.html )put a track of mine on their compilation without seeking my approval. Although the tracks are CC .. this doesn't mean that one should not be correct & ask for approval . Apparently they didn't ask approval from Doorchaser either .... Some of these tracks are also in the shortlist for my next Databloem release ... now they're contaminated for the recordlabel ( Same situation for Doorchaser) I asked these guys already for an explanation with the first insert of a track of mine into their compilation ... no answer .. now they've done it again ...
I'm not amused ...
Dirk aka BpOlar

ah well, at least it's your name next to it. whole different situation then just stealing it, ay? k it's not decent not to ask, but hey, worse can happen... i know i wouldn't like it either, but don't worry, be happy
just put low quality mp3/faded clip/short clip
Databloem huh? this your first release?? nice work man!!! Databloem is teh chillout pants!
I'm on it too ;)
would have been nice if they'd asked it, but i see it as a compiment....
still it wouldn't have hurt them if they'd asked...
can you send me their email, Dee ?

I've mailed them on their 'Myspace' account the first time they made a compilation , asking them to seek my approval next time ... now they did it again
It would piss me off too certainly if the tracks were to be released. Had a similar case (exept they changed the tracktitle and used their names instead of mine), thats why I also tend to put more low quality tunes on ebel...
have a word with them, cose it's indeed quite respectless
i don't know exactly the rights CC give to this guy, but as the artist you have the right to decide where your tracks appear or not. so this is illegal and you can probably sue him (in theory. don't do it).
but maybe creative commons change that.
That's a clear Creative Commons infringment... not a question of politeness.
EDIT:
I was wrong.
Well... this is the license under which you (Bpolar) released your song.
*Attribution-Noncommercial-No Derivative Works 2.0 Generic You are free:
* to Share — to copy, distribute and transmit the work
Under the following conditions:
*
Attribution. You must attribute the work in the manner specified by the author or licensor (but not in any way that suggests that they endorse you or your use of the work).
Attribute this work:
What does "Attribute this work" mean?
The page you came from contained embedded licensing metadata, including how the creator wishes to be attributed for re-use. You can use the HTML here to cite the work. Doing so will also include metadata on your page so that others can find the original work as well.
*
Noncommercial. You may not use this work for commercial purposes.
*
No Derivative Works. You may not alter, transform, or build upon this work.
* For any reuse or distribution, you must make clear to others the license terms of this work. The best way to do this is with a link to this web page.
* Any of the above conditions can be waived if you get permission from the copyright holder.
* Nothing in this license impairs or restricts the author's moral rights.*
so... the use of your song is legal as long as the non-commercial publisher gives the name of the author and the origin of the song - in this case electrobel. **As far as I see the only allegation you can hold besides elementary politeness, is that Labomix did not specify under which license the song was initially published, nore the license of their compilation release. **This is requested by the license featured above.
**On other releases by Labomix these conditions (origin & license) are not fulfilled, but possibly they had individual written agreements with all of the authors whose songs were used. I cannot know that. **
**CruizeOfFictions prementionned case was different. That one was an obvious theft of intllectual property. **

As said before , I send a mail to their Myspace account the time of the first compilation , stating that I didn't like the fact that they did not seek permission.
I can live with the fact that they do these things in Russia ... but not from other apparent Ebel members
