I think samples < 2seconds are legal, or something like that ... Mmh, someone know a specialised lawyer ?

I also think the '2 seconds' rule doesn't exist. Even for the smallest fragment you have to pay royalties (unless you mangle it through filters and FX so even the owner/creator doesn't recognise it anymore). :P

In general commercial sample CDs (like the AKAI/EMU or Gigasampler libraries) should already be cleared and can be used without any problem. Normally this should be mentioned in the booklet.

But don't take my word for it. (I'd create my own samples). :D

Any input on this subject would be more than welcome.
