if the sample is from a worldfamous tune, i assure u, it won't be royalty-free. even if it's in a free sample-pack

Sample packs are full of copyrighted material. More often than not, it is CR material actually.

It's you as an artist or any site hosting your stuff that would get trouble. For all we know you plugged it off a torrent.

Probably plenty of sample packs popping up this week by Michael jackson, doesn't make Sony ok with it.

And please, let me tell you something: we mods are doin this because music is our passion, because we believe  in music. But we are not robots or people at your service, so YOU better explain why you used a copyrighted sample, and tell us its coming from a free sample pack. Stay humble, and dont sream at mods please   :) Now, if you want to know the full story: WHEN YOU UPLOAD A SONG, IF YOU READ THE CONDITIONS, IF CLEARLY WRITTEN YOU DO NOT HAVE RIGHT TO UPLOAD COPYRIGHTED MATERIAL...  :D   so do we still have to explain why your song was blocked... think twice before askin us to explain what we do  peace    im a bit hard, but there are not negative feelins ok  :)

And sure, I get it there cant be copyrighted material on this site, but as I said: I dont think it IS copyrighted.  Just my 2 cents

Considering the fines you can get, it's better to block a track too much than let one slip. If the sample features in a world famous track, chances are pretty high it's not free to use. Also a free samplepack is not much of a reference, I can sample all kinds of stuff and put it in a free sample pack on the net. If it's a paid for samplepack from companies like loopmasters, that's already better, but still no guarantee.

It's a grey zone, but world famous typically means no go. (you won't get away with a  sample from the matrix, but sample some fifties japanese movie and you'll be rather safe)

the first respect step is to read what you can do or not when you enter a community.  now about my answer, the intention was not to hurt you or somthin, so here  s my ppologies if it was the case... Next time think twice before posting something with a free sample, nobody wants to pay the fee to SABAM, and if you want to know, they are on us, they watch us, we already had troubles, we wont let it happend again  :) keep on producin, and see ya man  :)

hmmm is there also a few seconds rule when sampling ?or if you transform the sample in that way it's hardly hearable? I'm having a lot of doubts on this issue...

Technically, if you sample something it is copywritten no matter how long  you sample it or what you do to it. Ofcourse, proving that it is copyrighted material is another thing. "Het is niet gelijk hebben, maar gelijk krijgen waar het om draait"

Say you sample a kickdrum from the TR-808, then there's no probem, because you're recording original material. Now sample that same 808 kickdrum off a tune, then there is a problem because that 808 kickdrum sound is copyrighted. The thing is that you won't get into trouble with this because no one can prove you sampled it from the tune, it might just as well come from the real 808.

The problem in this thing is that you also need WRITTEN consent from the original artist, person, president, bull toad, whatever that did what you're intending to do.

So if you're going to use, say, an Obama sample, then good luck :)

It doesn't matter how much you distort it. Unless you distort it to the point of no-one ever recognising it, in which case, why bother sampling it.

Just for a little real-life perspectie: Roy Orbison was always looking for approval until his death and gave his consent left and right, but he flat out refused for Lynch's Blue velvet due to how it would be used (drug use etc.). Lynch used it and well...

Now, the argument that it would only be listened to a couple of times etc. is sometimes thrown up, but in a case such a hosting website as this, the amount is calculated on a by-month ratio. So even if there's 5 tracks for 6 months, you're already looking at more than 100 euro for a LEGALLY used sample (I.E., all tracks got the ok from the original).

Hmm maybe a bit off-topic, but what if you use a quote from a famous movie, would it get blocked to? Cause there are lot's of famous released tracks out there with such quotes, and i don't think those artists all pay royalties...
